“Wanderlust - Ontop Card Reloaded”

These terms and conditions (these “Terms”) regulate the “Wanderlust - Ontop Card Reloaded” campaign (this “Campaign”). Through the Campaign, Ontop Card holders that make at least one purchase equal to or exceeding 20 USD within the Campaign Period (as defined below) may be eligible to receive a free month of Wanderlust Subscription Plan.

1. DEFINITIONS:

1.1 “Campaign Period” means the period between Tuesday, April 9, 2024, 5:00 am (GMT-5), and Thursday, April 11, 2024, 5:00 pm (GMT-5).

1.2 “Ontop Card” means a digital prepaid card that Workers can acquire through the Ontop Platform and top up by using their Ontop Worker Wallet balance.

‍

1.3 “Ontop Worker Wallet” or “Worker Wallet” means the electronic or digital wallet account available to Workers from within the Ontop Platform that allows you to receive compensation payments from Clients and make electronic transactions to your own personal account(s) or to third-party accounts.

‍

1.4 “Subscription Plan”, under these Terms, means the Wanderlust Subscription Plan where “Subscribers” to this plan pay a monthly or anual fee to receive Cashbacks and other benefits related to their Ontop Card and/or Worker Wallet spending.

‍

1.5 “Wanderlust” means the premium Subscription Plan and applicable features and benefits available under the Wanderlust Terms of Service.

‍

Any definitions that are not defined by these Terms will have the meanings ascribed to them in the Wanderlust Terms of Service.

2. CAMPAIGN  RULES:

2.1 To qualify as a participant in this Campaign (“Participant”), you must:

‍

a. receive an email communication from Ontop confirming your participation in this Campaign;

‍

b. currently reside in Argentina, Colombia, Mexico or Panama;

‍

c. have an active Ontop Card or activate your Ontop Card within the Campaign Period; and

‍

d. make at least one (1) purchase equal to or exceeding 20 USD with your Ontop Card within the Campaign Period.

‍

2.2 Participants in this Campaign may be eligible to receive a free month of Wanderlust Subscription Plan (the “Wanderlust Bonus”). The Participants will receive an email with the instructions to claim the Wanderlust Bonus.

‍

2.3 The Wanderlust Bonus will be granted by activating the Wanderlust Subscription Plan to the Participant, within the next 24 business hours after the Participant completes the instructions set on the email mentioned in Section 2.2.

2.4 Upon expiration of the Wanderlust Bonus, the Wanderlust Subscription Plan will be automatically renewed.

‍

2.5 The Wanderlust Bonus is personal and non-transferable. Please, bear in mind that the Wanderlust Bonus might be considered a gift in your country of tax residency and, therefore, may be subject to tax payments or declarations. You are solely responsible for any federal, state, and local taxes and any other fees, charges, or expenses associated with the Wanderlust Bonus.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 The Campaign will be valid throughout the Campaign Period.

3.2 Ontop reserves the right to (a) cancel, suspend, and/or modify the Campaign and (b) to block a Participant’s account at any time if it is determined that fraud or unlawful action is taking place in order to win the Wanderlust Bonus.

3.3 Ontop reserves the right to modify the conditions of eligibility for this Campaign and/or to cancel the Campaign, at any time and at its sole discretion.

3.4 Please refer to our B2C General Terms and Conditions and Privacy Policy, as well as the Ontop Card and and Wanderlust Terms of Service (collectively the “Ontop Platform Terms”), which will govern any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms will have the meaning ascribed to them within the Ontop Platform Terms.

3.5 As per Section 16 of the Ontop Card Terms of Service: (i) these Terms will be governed by and construed in accordance with the law of the State of Delaware; and (ii) any dispute in connection with these Terms that cannot be resolved amicably will be resolved by binding arbitration on an individual basis.

3.6 By participating in the Campaign, you acknowledge and agree that the Company may collect, store, and use any personal information you provide in accordance with our Privacy Policy.
